New Removal Provisions in the Nationality and Borders Act 2022 coming into force from 20 November 2023

 Regulation 2 of the Nationality and Borders Act 2022 (Commencement No. 7 and Transitional Provisions) Regulations 2023 mean that for removal decisions from 20 November 2023, removal decisions will be subject to a statutory obligation requiring a minimum of 5 working days’ notice period to provide a person with details of notice of intention to remove and details of departure. Prior to this, removal notice periods were outlined in the Home Office guidance. 

 

In many cases, a removal notice can be relied on for a period of 21 days. In cases where a person is refused entry into a port, removal should take place within 7 days. In addition to this, if a person’s judicial review application is unsuccessful, they may be subject to removal.
